Litigation, insolvency proceedings

During the drafting of contractual documentation the law firm places special emphasis on dispute prevention. Our aim is always to ensure that the documentation is unequivocal and that its provisions rule out any future disputes over interpretation and eliminate any legal uncertainty.

We have extensive experience representing clients in court proceedings, arbitration and insolvency proceedings. We provide all legal services associated with dispute resolution arising from contracts or breach of statutory provisions. We focus on disputes connected with business activities but can act in disputes unrelated to business activities. Our firm represents clients in legal matters in courts of all instances as well as before arbitration courts and other bodies providing alternative dispute resolution. We represent clients in the capacity of both the plaintiff and the defendant.

We provide legal services in insolvency proceedings both for creditors as well as for debtors. We claim receivables on behalf of the creditors and represent them in court proceedings. The law firm drafts insolvency filings on behalf of both creditors and debtors, which can be connected with proposals for permission to debt relief. We represent clients in case of chicanery insolvency petitions and in incidental disputes.

Debt collection

Debt collection and management of receivables is, thanks to court-appointed debt collectors and still improving legal regulation, much more effective than it was previously. Nevertheless, it is still necessary for creditors to not only wait for payment, but to actively manage their receivables. The court proceedings leading to obtaining an enforceable court ruling still take too long.

We offer our clients in this context:

  • To legally secure the debts clients are owed (mortgage contracts, bills of exchange given as security, guarantees),
  • send prompt reminders to debtors,
  • contest legal transactions made by debtors that cause damage to creditors,
  • cession of receivables and setting off the debts one is owed,
  • preparation of agreements of acknowledgement of debts or agreements on repayment schedules.

We represent clients in court proceedings and subsequent enforcement proceedings regarding their receivables. We also represent creditors in the ongoing insolvency proceedings in the event of the debtor’s bankruptcy.
